New York State Police initiated a traffic stop on Boston Post Road in Port Chester after observing a violation on Sunday, Nov. 10 around 2:30 a.m.
The driver of the vehicle, identified as Silvano Perez Garcia, 53, of White Plains, was found to be intoxicated, according to police.
Garcia was arrested, transported and processed at SP New Rochelle, where police say his BAC was tested at .20.
Garcia also has a prior DWI conviction within the last 10 years and is required to operate a vehicle equipped with an ignition interlock device, which police say his vehicle did not have.
Garcia was subsequently charged with aggravated driving while intoxicated, a Class E felony, operating a motor vehicle with no ignition interlock device, a Class A misdemeanor and various vehicle and traffic violations.
Garcia was ticketed and released to a sober third party. He is scheduled to appear in the Village of Port Chester Court on Friday, Dec. 6.
